Aretha's Christmas: 'Silent Night' with Four Tops (AP)

DETROIT ? Detroit's Queen of Soul knows how to throw a Christmas party, and she welcomed in the holiday with glitter, a jazzy musical backdrop and a finale of "Silent Night" with the Four Tops.

Aretha Franklin held her annual Christmas party on Friday at the Detroit Athletic Club, greeting guests in a teal blue gown accented with a silver sequined bodice.

The Detroit News reports ( http://bit.ly/tPkXO9) that Franklin exchanged gifts with family and friends as Ursula Walker, Buddy Budson, Marian Hayden and Gayelynn McKinney played jazz in the background.

During a meal of filet mignon and salmon, guests were entertained by performances by Gwen & Charles Scales and Franklin's son Eddie Franklin, who sang "Some Enchanted Evening."

Mother-Toddler Bond May Influence Teen Obesity (HealthDay)

MONDAY, Dec. 26 (HealthDay News) -- Teens are more likely to be obese if they had a poor emotional relationship with their mother when they were toddlers, according to a new study.

The findings echo previous research showing that toddlers who didn't have close emotional ties with their parents were more likely to be obese by the time they were 4.5 years old.

In the latest study, researchers examined U.S. National Institute of Child Health and Human Development data collected from hundreds of families who lived in nine states and had children who were born in 1991.

The analysis showed that the children's risk of obesity at age 15 was highest among those who had the lowest-quality emotional relationship with their mothers when they were toddlers, the Ohio State University researchers said.

More than one-quarter of the toddlers who had the lowest-quality relationships with their mothers were obese as teens, compared with 13 percent of those who had closer bonds with their mothers in their early years, according to the report published online and in the January print issue of the journal Pediatrics.

These and previous findings indicate that the risk of obesity may be affected by areas of the brain that control emotions and stress responses working together with those that control appetite and energy balance, the investigators explained.

The authors suggested that obesity prevention efforts should include strategies to improve the mother-child bond, as well as promoting healthier eating and exercise.

"It is possible that childhood obesity could be influenced by interventions that try to improve the emotional bonds between mothers and children rather than focusing only on children's food intake and activity," lead author Sarah Anderson, an assistant professor of epidemiology, said in an Ohio State University news release.

"The sensitivity a mother displays in interacting with her child may be influenced by factors she can't necessarily control. Societally, we need to think about how we can support better-quality maternal-child relationships, because that could have an impact on child health," Anderson added.

Is Gamification Right For Your Business? 7 Things to Consider

This year has lent itself to a slew of new buzzwords, and gamification is easily one of the most buzzed about in the marketing industry.

Businesses clamored this year to understand the concept of gamification and apply it to their digital and mobile products, offering badges and points galore ? but how many of them actually understand the point of gamifying or if it?s even useful for their business goals?

Dustin DiTommaso, the experience design director at design studio Mad*Pow, recently spoke about designing meaningful interactions through game design thinking during his presentation at Geekend 2011, a techie conference presented by BFG Communications.

DiTommaso explained his framework for gamification and dished out seven essentials steps for approaching the subject. Read on for a thorough encounter of DiTommaso?s model for architecting more meaningful interactions and successful business goals, and let us know your thoughts on his method in the comments below.


1. Consider Why You Want to Gamify


Yes, gamification is a sexy word. No, it isn?t right for every business.

DiTommaso recommends that businesses looking to gamify their products or services ask themselves three critical questions before moving on:

  • What is the reason for gamifying your product or service?
  • How does it benefit the user?
  • Will they enjoy it?

If you can answer these questions with confidence, if gamification seems like a good fit for your business? product or service and if the users enjoy it, then move on to exploring your business goals. DiTommaso recommends exploring the following three questions:

  • What are your business goals?
  • How do get the users to fulfill those business goals?
  • What actions do you want users to take?

If this exploratory phase yields positive feedback, your business is ready to move into user research.


2. Identify Your Users


It isn?t enough to understand your business goals when considering gamification ? you also need to understand your users and what motivates them. Research your users before you begin designing your gamified product, focusing on how they use your software, what they want and what motivates them.

DiTommaso laid out a number of questions to help businesses achieve research-inspired design:

  • Who are your users?
  • What are their needs and goals? Why are they playing?
  • What?s holding them back from achieving their potential? Is it lack of volition (belief that completing the task at hand is valuable) or lack of faculty (ability to complete the task)?
  • What is their primary playing style (solo, competitive, cooperative)?
  • Who are they playing with?
  • What social actions do they find enjoyable, and why?
  • What metrics do they care about?

Game designers must also understand what motivates users to play their games. There are a number of motivational drivers, but DiTommaso recommends simplifying to four key factors. Decide if your users are motivated by:

  • Achievement of goals or enjoyment of experience
  • Structure and guidance or freedom to explore
  • Control of others or connecting with others
  • Self-interest in actions or social interest in actions

Knowing these details about users and their motivations will assist game designers in determining how the game should be laid out, how much autonomy to allow, what the users? goals should be and so on. Let?s explore exactly what comes next in the designing process.


3. Frame Goals and Objectives


The user?s path to mastery should entail ?a journey up, with a quick little dip for relaxation ? where you have either a break or a new challenge to master, like crossing a log ? and then one, final, arduous climb to the top,? says DiTommaso.

Once you understand your business goals and your users, you can begin to design goals and objectives while thinking about long-term and short-term user goals.

DiTommaso advises, ?Figure out a way to make long-term and short-term goals as exciting and aspirational as possible.? Users want to be heroes ? design their gaming experience so that they can achieve that.

The long-term goal must be compelling and fairly difficult to achieve, says DiTommaso. This can be framed as the mastery of a new skill or habit, or the acquisition of an achievement or title. In the end, though, it is important that the long-term goal signify a ?pinnacle of personal growth,? says DiTommaso.

Once you figure out a long-term mission for users, break it up into small milestones that take users along a path to success. These ?discrete and satisfying challenges? should motivate users to continue on and help them improve along the way.


4. Identify Necessary Skills and Actions


Make a list of all of the abilities that are necessary to win your game. DiTommaso breaks these skills into three categories for easy brainstorming:

  • Physical Skills: walking typing, using a chef?s knife
  • Mental Skills: pattern recognition, memory, spatial logic
  • Social Skills: presentation, conversation, meeting new people

DiTommaso advises that game designers choose skills that take time to master, can be developed over time and can be broken into smaller ?skill-chains.?

It is important to determine if and how the skills you are considering can be measured, so that you can track a user?s advancement. Determine whether there is existing technology that can help you monitor and track progress of certain essential skills.


5. Consider Various Lenses of Interest


In ?The Art of Game Design: A Book of Lenses,? Jesse Schell outlines the psychological lenses that are key to making top-notch games. Lenses help game designers view their games from many different perspectives, or lenses.

While Schell?s book identifies 100 lenses, DiTommaso pointed out 10 particular lenses to focus on for starters:

  • 1. Competition Type: Player vs. player, player vs. system, self-directed
  • 2. Time Pressure: Relaxed, exploratory play or brash-tactics-get-things-done play
  • 3. Scarcity: Scarcity can add a level of challenge and strategic gameplay
  • 4. Puzzles: Puzzles are problems that promise the existence of a solution
  • 5. Novelty: Change presents a new set of challenges and patterns to master
  • 6. Levels: Graph progress, ability and access and provide a roadmap of progress
  • 7. Social Pressure / Proof: Show users how others are excelling in the system ? via a leaderboard, for example
  • 8. Teamwork: Teamwork can also act as resistance when users need to work with others
  • 9. Currency: Anything that can be exchanged for something of value will be sought
  • 10. Renewals and Power-Ups: Renewals and power-ups help ?unstick? players and redirect them from dead-ends

Framing problems, core objectives and actions in your games using these tenets will often yield a better gaming experience for users.


6. Outline Desired Outcomes


Think about the types of rewards and punishments that will result from a user?s actions ? this should create a feedback loop that motivates users to improve.

Positive feedback could include rewards, such as moving up a level, unlocking a badge or earning points ? and negative feedback might entail starting a challenge over, for example.

?Outcomes can be contingent or schedules,? says DiTommaso. ?Players can trigger an outcome based on specific actions they take or based on a time frame within the game.?

No matter the time frame, though, players should always see their progress towards the ?ultimate objective,? which DiTommaso also calls the ?Epic Win!? Incremental success and failure will guide them along.


7. Play and Polish


?Platforms are never done,? says DiTommaso. Once you have the game build, test and polish it. Here is a framework DiTommaso suggests for analyzing the game:

  • What?s working and what isn?t?
  • What have you not considered?
  • Is the game personal enough for your users?
  • Do they feel that it?s tailored to their own unique personality and desires?
  • Are you tapping into the player experience needs of competence, autonomy and mastery?
  • What?s going to keep it interesting in 10 weeks? In 8 months?
  • When player reaches the Epic Win!, it?s time to go back to the drawing board.

DiTommaso recommends that game developers not spend too much time testing games, though. ?Get it out there and let your users be the testers,? he says. Users expect iterations and software updates, so don?t be afraid to release and iterate, he says.

Kim Jong Un, who is in his late 20s and was unveiled in September 2010 as his father's choice as successor, will be the third-generation Kim to rule the communist nation of 24 million.

Dune Energy Completes Financial Restructuring by Closing Exchange Offer and New Bank Credit Facility

HOUSTON, Dec. 22, 2011 /PRNewswire/ --?Dune Energy, Inc. (OTCBB:DUNR) ("Dune") announced today that it has completed its financial restructuring, including the consummation of the purchase of $297,012,000 in aggregate principal amount of its 10.5% Senior Secured Notes due 2012 (CUSIP NO. 265338 AC 7), in exchange for:

  • shares of its newly issued common stock and shares of a new series of preferred stock that have been converted into common stock, which in the aggregate constitute approximately 97.0% of Dune's common stock on a post-restructuring basis; and
  • approximately $49.5 million aggregate principal amount of newly issued Floating Rate Senior Secured Notes due 2016.

The notes purchased in the exchange offer constituted 99% of Dune's senior notes outstanding prior to closing.

As a component of the restructuring, and with the requisite consent of its preferred stockholders, all of Dune's 10% Senior Redeemable Convertible Preferred Stock was converted today into $4 million in cash and shares of common stock constituting approximately 1.6% of Dune's common stock on a post-restructuring basis.

Completion of the restructuring resulted in Dune's pre-restructuring common stockholders holding approximately 1.35% of Dune's common stock on a post-restructuring basis.

After the restructuring, percentage ownership of Dune's common stock will continue to be subject to dilution through issuance of equity compensation pursuant to Dune's equity compensation plan.

As part of its overall financial restructuring, Dune has also entered into a new $200.0 million senior secured revolving credit facility with an initial borrowing base limit of up to $63.0 million, with BMO Capital Markets Corp. as Sole Lead Arranger and Sole Bookrunner, Bank of Montreal as Administrative Agent and CIT Capital Securities LLC as Syndication Agent.

In addition, as part of its restructuring, Dune implemented a 1-for-100 reverse stock split which will be effective at the close of business today.? Post the restructuring and the reverse stock split there will be approximately 36.1 million shares outstanding.

James A. Dune announced in a prior press release the successful testing of the CNO #1 well in the Leeville field, Lafourche Parish, Louisiana.? This well has been put on production at a sustained rate of over 4 mmcfe/day.? Dune has a 40% interest in this well.? The Toalson #1-H well in the Pearsall Field, Frio County Texas has been drilled to a total depth of 10,046 feet, including 4,046 feet of horizontal section in the Austin Chalk.? The well is currently undergoing testing with full production anticipated early in 2012.? Dune has a 40% interest in this well.? Dredging activities have been completed in the Garden Island Bay field for commencing drilling on the Gromit prospect in January.? Dune will have a 100% working interest in this well.? Based on recent drilling successes, Dune anticipates exiting 2011 at approximately 17.5 mmcfe/day or 2 mmcfe/day above the third quarter rates.

Canon imageClass MF4570dw


We don't usually review printers like the Canon imageClass MF4570dw ($299 direct) that are virtually identical to one we've already reviewed except for the addition of WiFi. We made an exception in this case primarily because the Canon imageClass MF4570dn ($299 direct originally, 4 stars) is an Editors' Choice, and we wanted to see if the MF4570dw, would be one as well. It isn't, but it comes close, and is certainly worth considering if you need a mono laser MFP for a small or home office.

First, to avoid confusion about prices, note that the dw model is the same price that the dn model was when Canon first announced it. Since then, Canon's dropped the price on the MF4570dn to $249, making it an even better value. And one way to think about the dw is that it's the same printer with WiFi added for $50 extra. However, there are some other interesting differences.

Canon is moving towards shipping all of its laser printers that include duplexing (two-sided printing) with their drivers set to duplex by default. This new approach started with the current crop of newly announced models, including the MF4570dw. Given that few people change settings for their drivers?which is why we run most of our tests using printer defaults?it's a good bet that most people will print with the default duplex setting. The best argument for this change to duplexing is that it helps make printing a little more eco-friendly, since it uses less paper. However, it also slows down print speed, and it creates at least one problem.

When you set a printer for duplex, you also have to tell it whether to want the two sides printed so you can read the document by flipping the page on its long side, like a book, or short side, like a steno pad. The default setting on the Canon driver assumes you want to flip the pages along the long side, which is fine for pages you want to print in portrait mode, but the wrong way for my tastes for pages printed in landscape mode.

I'd argue that if you are going to make duplex printing the default, you should also add separate settings for portrait and landscape modes for the direction to flip the page, and ask the user to choose the default flip settings during setup. Otherwise, odds are you'll forget to change the setting before printing with some regularity, have to reprint the document, and wind defeating the ecological benefit of having the duplex setting in the first place. So count the default duplexing as proving that Canon has good intentions, but didn't think through this particular change very well.

Basics and Setup
The MF4570dw shares the dn model's size, making it a little big to share a desk with, but reasonably compact, at 14.6 by 15.4 by 16.6 inches (HWD), and easy to find room for in the typical micro office or busy home office it's aimed at. Like the MF4570dn or the directly competitive Brother MFC-7860DW ($300 street, 3.5 stars), it can print, scan, and fax, even over a network, and work as a standalone copier and fax machine.

It also offers a 35-page automatic document feeder (ADF) for scanning multipage documents as well as legal-size pages, which are too big for the flatbed. And with a 250-sheet input tray and 1-sheet manual feed, as well as the duplexer, it offers an appropriate level of paper handling for most micro or home offices. If you need more, however, you'll have to go elsewhere, since there are no options for additional trays.

Setup is standard fare. For my tests I connected the MF4570dw to a wired network and installed the driver on a Windows Vista system.

Speed and Output Quality
Because of the default setting to duplex printing, the MF4570dw is a bit slower than the MF4570dn on our tests, but Canon rates the printer at the same 26 pages per minute (ppm) for simplex (one sided) printing, and 16 ppm for duplex.

On our business applications suite, (using QualityLogic's hardware and software for timing), the printer managed an effective 9.8 ppm in its default duplex mode. Although that's slower than the MF4570dn, at 12.3 ppm, it's still reasonably fast. In fact, the printer essentially tied the MFC-7860DW, for example, at 9.7 ppm as well as the more expensive Editors' Choice Brother MFC-8480DN ($400 street, 4 stars) at 10.6 ppm. (Differences of 1 ppm or so on our tests aren't significant for lasers.) In addition, I ran the MF4570dw through the tests in simplex mode, and timed it at the same speed as the dn model.

Not surprisingly, the MF4570dw offers essentially identical output quality to the MF4570dn. Text is a touch below par for a mono laser, which is still good enough so you shouldn't have any complaints unless you need a printer for serious desktop publishing or have an unusual need for small fonts. Graphics and photo output are both par for a mono laser MFP. For graphics, that means it's easily good enough for any internal business need. For photos, it's suitable for printing Web pages with recognizable photos or printing photos in client newsletters and the like.

Much like the MF4570dn, the Canon imageClass MF4570dw offers all the features you need for a small or home office, reasonably good speed and output quality, and sufficient paper handling. And if you don't want to print in duplex, you can always change the default setting to simplex. If you don't need WiFi, the MF4570dn is obviously the better choice. If you do need it, you'll want to take a close look at the Brother MFC-8480DN as well, but the Canon imageClass MF4570dw is a more than reasonable choice and a potentially good fit for any micro or home office.

Romney says he would deport Obama's uncle (AP)

ASHLAND, N.H. ? Republican presidential hopeful Mitt Romney says he would deport President Barack Obama's uncle, who police say was arrested in August for drunk driving near Boston and is an illegal immigrant.

In an interview with Boston radio host Howie Carr on Wednesday, Romney said "yes" when asked if Onyango Obama should be deported. Romney at first did not recognize the name, but said the nation's immigration laws should be enforced.

Onyango Obama is the 67-year-old half-brother of the president's late father. His case is pending in Framingham, Mass., District Court. He was initially held without bail on a detainer from U.S. Immigration and Customs Enforcement officials on allegations he violated an order to return Kenya issued 20 years ago but has since been released.

Stocks climb on manufacturing, jobs data?

NEW YORK ? Investors shifted their attention from Europe to the U.S. on Thursday, pushing stocks slightly higher on good jobs and manufacturing reports.

The Dow Jones industrial average rose 45.33 points, or 0.4 percent, to 11,868.81. The Dow had lost 360 points over the past three days on worries that Europe's latest plan to keep its currency union intact would fail.

Jack Ablin, chief investment officer at Harris Bank, said the break from selling meant that investors are starting to focus on signs of strength in the U.S. economy.

"We're not completely insulated (from Europe), but trouble there doesn't necessary spell problems for us," he said.

Before the market opened, the government reported that the number of people applying for unemployment benefits dropped sharply last week to 366,000, the fewest level since May 2008. That's a sign that layoffs are easing, a first step toward bringing down the unemployment rate, which currently stands at 8.6 percent.

Investors were also encouraged by a report from the Federal Reserve of New York that its index measuring regional manufacturing jumped to the highest level since May. That was far more than economists were expecting. A similar report from the Philadelphia branch of the Fed also increased more than analysts anticipated.

"The base of the economy is getting stronger," said Steven Malin, an associate at money manager Aronson Johnson Ortiz.

FedEx Corp. reported that its quarterly income nearly doubled on strong growth in online shopping during the holiday season. FedEx is seen as a bellwether for the economy. Its stock jumped 8 percent.

The Standard & Poor's 500 rose 3.94 points, or 0.3 percent, to 1,215.76. The gains were broad. All but two of the 10 industry groups in the index rose. The two groups ? technology and energy ? edged down less than 0.3 percent each.

The biggest gains were in utilities and health care stocks. The profits of those companies are less likely to crumble in an economic slowdown. That suggests that investors, though encouraged by the good news Thursday, were still playing it safe.

"There's a defensive tone to the market," said Jeff Schwarte, a portfolio manager at Principal Global Investors. "Investors still aren't sure about the economy."

The Nasdaq rose 1.70 points, less than 0.1 percent, to 2,541.01.

In other corporate news:

  • Michael Kors Holdings Ltd. jumped 21 percent to $24.20 on its first day of trading. The initial public offering valued the fashion design company at $3.8 billion.
  • Novellus Systems Inc. jumped 16 percent. The semiconductor equipment maker said late Wednesday that it was being acquired by rival Lam Research Corp. Lam fell 8 percent.
  • Rite Aid Corp. rose 3.5 percent. The drugstore chain announced that losses had narrowed in its third quarter.

European markets rose slightly, a day after big declines, as an auction of Spanish government bonds drew strong demand from investors. Germany's DAX rose 1 percent; France's main stock index rose 0.6 percent.

The euro rose against the dollar, moving back above $1.30, a day after hitting an 11-month low. The yields on Spanish and Italian government fell, a sign that investors were less worried about the ability of those countries to pay back their debts.

David Boaz: Rick Perry's Pension Problem -- And Ours

Texas Governor and presidential candidate Rick Perry is collecting a $92,000 annual pension on top of his salary as governor, according to financial disclosure forms just filed. State law allows government workers to collect retirement benefits while still working if they meet certain age and service requirements. So Texas taxpayers have been paying Perry a salary as an elected official for 26 years, and now they're also paying him a handsome pension benefit. With his salary of $133,000, his total taxpayer compensation is $224,000 annually.

Why should elected officials receive a pension at all? Service in elected office should be temporary, not a career.

But Rick Perry is not the only government official double-dipping on salaries and pensions, nor is his $92,000 pension the one that will bankrupt the taxpayers.

The Perry story reminds me of former Maryland Governor Parris N. Glendening. When he was elected in 1994, Glendening seemed a clean, honest, moderate, technocratic former professor. He might give Maryland big, expensive government, but at least it would be clean government in a state with a long legacy of corruption. Then, a few days after his inauguration, came the news that Glendening and his top aides were collecting tens of thousands of dollars in early pension payments from Prince George's County, where Glendening served as county executive until his election as governor. The windfall was due to Glendening's creative interpretations of rules that gave early pension benefits to government employees who suffered "involuntary separation" from their jobs. Glendening decided that officials not allowed to seek re-election because of term limits, such as the two-term limit on the county executive, had been "involuntarily separated" from their jobs. And he "demanded" the resignations of his top aides a month before he left his county job -- making them also victims of "involuntary separation" -- whereupon he hired them as his top aides in the governor's mansion.

More recently, legislators in 33 states have passed laws that give themselves pension perks that other state workers don't get.

Outrageous as these stories are, they're not going to bankrupt the states. The real pension problem is the massive unfunded liabilities facing taxpayers in almost every state. The Pew Center on the States estimates that states face a $1.26 trillion gap between what they owe in retirement benefits and what they have set aside. Robert Novy-Marx of the University of Chicago and Joseph D. Rauh of Northwestern University find even more breathtaking liabilities

"Using market-based discount rates that reflect the risk profile of the pension liabilities, we calculate that the present value of the already-promised pension liabilities of the 50 U.S. states amount to $5.17 trillion, assuming that states cannot default on pension benefits that workers have already earned. Net of the $1.94 trillion in assets, these pensions are underfunded by $3.23 trillion. This "pension debt" dwarfs the states' publicly traded debt of $0.94 trillion."

Economist Jagadeesh Gokhale also estimates that accurate calculations might add 50 to 100 percent to reported state pension liabilities. Meanwhile, states are resisting proposed new accounting rules that would shine light on their liabilities.

Thomas Frank reported last week in the USA Today:

"Special retirement benefits once reserved for police, firefighters and others with dangerous jobs are now being given to tens of thousands of state workers employed as park rangers, foresters, dispatchers, coroners, even highway laborers, museum guards and lifeguards... Thirty-one states have passed laws since 2000 that expand the range of workers who can retire when they turn 50 or 55 or after working 20 or 25 years, then collect special pensions that will pay some an extra $1 million or more in retirement."

Why do pensions get so lavish? A 2009 study by the Cato Institute argued that in negotiations between elected officials and government unions, nobody really represents the taxpayers. Elected officials are far more responsive to organized interests like unions than to the unorganized citizen-taxpayers. In effect, the principal-agent problem that analysts of the corporation worry about is far worse in government because it is very difficult for taxpayers to control their theoretical agents, the elected officials and appointed managers of government.

Rick Perry should be embarrassed about living so high on the taxpayer hog. Parris Glendening and those legislators in 33 states should be ashamed of how they manipulated the rules in their own interests (speaking of how elected officials don't always serve as the taxpayers' agents). But for the rest of us, the real problem is that multi-trillion-dollar government-employee pension bill that's going to come due.

Brazil judge allows dam construction to continue

(AP) ? A Brazilian judge has revoked a decision that had halted some work on a massive hydroelectric dam in the Amazon jungle.

Federal judge Carlos Eduardo Martins halted construction on the $11-billion, 11,000-megawatt Belo Monte Dam in September, saying it would harm fishing on the Xingu River, which feeds the Amazon.

But on Friday, he ruled that construction could proceed because the Norte Energia consortium that is building the dam showed that the flow of the river would not be altered in a way that would harm the habitat of fish.

The judge's ruling has been posted on the court's website.

When completed, the dam would be the world's third largest behind China's Three Gorges dam and the Itaipu, which straddles the border of Brazil and Paraguay.

The government has said it will be a source of clean, renewable energy, and that it will help fuel the country's economy.

But environmentalists and indigenous groups say the dam would devastate wildlife and the livelihoods of 40,000 people who live in the area to be flooded.

Celebrities including British rock star Sting, film director James Cameron and actress Sigourney Weaver have joined activists in lobbying against the dam.

When Cameron participated in protests against the project in Brazil last year, he compared the anti-dam struggle by indigenous people to the plot of his film "Avatar," which depicts a natives of a planet fighting to protect their homeland from plans to extract its resources.

Court tells UK to release Pakistani in US custody (AP)

LONDON ? An appeals court issued a landmark ruling Wednesday ordering the British government to free a Pakistani detainee who has been held in U.S. custody for nearly eight years without charge.

It was unclear whether Yunus Rahmatullah would be released as required, however, because the U.S. government is not bound by the ruling. It announced that it was reviewing the ruling.

Britain has seven days to produce Yunus Rahmatullah, who is being held by American forces in Afghanistan, according to the Appeals Court's ruling.

Although Rahmatullah, 29, is not a British national, the UK-legal charity Reprieve filed a habeas corpus petition claiming that his detention lacked sufficient cause or evidence, and that British forces violated international law when they rendered him to U.S. custody.

British forces in Iraq seized Rahmatullah in 2004, but then handed him over to the Americans who sent him to the U.S. Air Base in Bagram, Afghanistan ? a sprawling base that includes the Parwan detention facility where just under 3,000 detainees are being held.

Wednesday's ruling marks one of the first times that a habeas corpus petition has been successful for a detainee at the U.S. base. It puts the United States and Britain in an awkward position ? Britain is bound by the ruling, but the United States is not because the decision was handed down by a foreign court.

Britain's Foreign Office and the Pentagon both said they were reviewing the court's decision.

"We are aware of the opinion and are reviewing the decision by the Court of Appeal (Civil Division)," said U.S. Department of Defense spokesman Lt. Col. Defense Todd Breasseale.

Reprieve first sued the British government to formally identify Rahmatullah. It then filed a habeas petition asking for his release. Wednesday's ruling reversed an earlier decision by the High Court, which refused to grant habeas relief ? a principle enshrined in English law for centuries.

"The court is quite right ? once the U.K. takes a prisoner it cannot simply wash its hands of him, or of the Geneva Conventions," said Cori Crider, Legal Director of Reprieve. "The (British) government stands warned: failure to get Yunus out of Bagram now may be to aid and abet a war crime."

The appeals court found that the British government has to take action.

"On the face of it (Rahmatullah) is being unlawfully detained and (British ministers) have procedures at their disposal ... to enable them to take steps which could bring the unlawful detention to an end," said one of the three appeal judges, Lord Justice Maurice Kay, in the ruling on Wednesday.

James Eadie, the attorney representing the Foreign Office and Ministry of Defence, said it wouldn't be appropriate for a British court to make a judgment on the lawfulness of U.S. detention and said ordering British ministers to demand Rahmatullah's freedom could affect Britain's relationship with America.

Unlike the U.S. detention facility at Guantanamo Bay in Cuba, detainees have no access to lawyers at Parwan.

The detention facility is slated to be turned over to Afghan authorities in the future.

Are married people 'nearly a minority'? (The Week)

New York ? According to new Pew Research numbers, fewer Americans than ever before are saying "I do"

The proportion of adults in the United States who are married has plummeted to a record low, according to new data released by the Pew Research Center. Just 51 percent of Americans are bound by matrimony, making married people "nearly a minority." What's behind the shifting stats? Here, a guide:

This is a record low?
Yes. The proportion of Americans who are married has been falling precipitously. While in 1960, 72 percent were married, by 2000, that statistic was only 57 percent, says Carol Morello at The Washington Post. The decline has been especially sharp in recent years. Between 2009 and 2010 alone, the rate declined by five percent. Also significant: Over 40 percent of adults under the age of 30 view marriage as an anachronistic institution. "They see it as an obsolete social environment," says Pew researcher D'Vera Cohn. Even people who say they want to get married are less likely to take the plunge.

What's the reason for the drop?
A number of factors are at play. For one, the median age at which people get married for the first time is at an all-time high: 26.5 for brides and 28.7 for grooms. This tendency to delay marriage means that only 20 percent of adults aged 18 to 29 are married today, compared to almost 60 percent in 1960. The stagnant economy has also exacerbated the drop, says Greg Howard at Slate. More people than ever ? 7.5 million ? are living together out of wedlock, an increase of 13 percent in just one year. "In many cases, the two couldn't afford to maintain two homes, so they shacked up without tying the knot."

Is marriage doomed?
Not quite. A majority of those who are unmarried ? 61 percent ? still want to get married, "even some of those who don't have a very rosy view of the institution," says Belinda Luscombe at TIME. Nearly half of those who think that "marriage is becoming obsolete" still aspire to marriage at some point. Furthermore, marriage is going strong in some social spheres. "Most college graduates will marry, eventually," says Morello. Two-thirds of those with degrees are currently married.

Could this dip be a good thing?
Perhaps, says Luscombe. These statistics may not signal the end of marriage entirely, but instead "the end of fewer marriages." Arguably, people "are being more judicious before they jump into a binding lifelong contract" while marriage is "losing its status as a social obligation." That "probably means fewer divorces."

Nebraska Nuke Plant Placed on Special Inspection Status (ContributorNetwork)

COMMENTARY | The Nuclear Regulatory Commission has taken the extraordinary step of moving the Fort Calhoun nuclear power plant to a special inspection status, Manual Chapter 0350. Fort Calhoun has been shut down since last April. Flooding by the Missouri River and a small fire that caused a power failure in a cooling system have contributed to the NRC's desire to provide enhanced inspection of the plant during its extended shutdown.

The move was announced by the plant's owner, the Omaha Public Power District, on Tuesday. The Washington Post reports the NRC's inspection revealed plant errors in providing incident warnings to local officials and a defective or improperly installed part that lead to the fire. OPPD states that they have "aggressively and thoroughly" addressed the issues. The change in status will allow the NRC to review process and procedural documentation, plans, maintenance and inspection reports and other material in an in-depth manner without affecting plant operations.

The Fort Calhoun nuclear power plant shut down in April of 2011 for routine refueling. In early June, prior to the plant coming back on line, record flooding of the Missouri River began in the area. The plant was surrounded by flood water but none of the critical areas were flooded. A complex series of berms and other flood control measures kept the reactor building and the building housing spent fuel rods dry. Areas of the plant that were unprotected, or were temporarily flooded, are now dry and have been returned to service.

OPPD spent $15.8 million to replace the electric power that Fort Calhoun would have generated during the flood. The costs of purchased electricity will continue to increase as the plant remains in extended shutdown. An added $28.7 million was spent on flood control measures at all of the OPPD facilities threatened by the Missouri River flood, including Fort Calhoun. The utility hopes that a combination of insurance reimbursements and federal flood assistance will allow recovery of most of these costs.

Plant operators had hoped to have Fort Calhoun in full operation by January. With the new inspection status, it is unclear when the plant will resume electrical production.

Gov. Jerry Brown implores California voters: Please raise taxes on yourself

Republicans blocked the efforts of California Gov. Jerry Brown to fix a budget crisis through more tax revenues. So his new plan is to go straight to voters in 2012.

Gov. Jerry Brown on Monday proposed a ballot initiative that would ask Californians to raise taxes on themselves.

Facing huge deficits despite $10 billion in budget cuts last year, California needs new tax dollars in order to avoid catastrophic cuts to schools and government services for the elderly, Governor Brown said.

His plan includes a 1 percent income-tax-rate increase for individuals making more than $250,000 per year, and a 2 percent rate increase for those making more than $500,000. It would also increase the state sales tax by half a cent to 7.75 percent.

In total, at least 10 initiatives that propose tax increases are vying to qualify for the 2012 ballot in California ? a sign that the state that led the national tax revolt with Proposition 13 in 1978 might now be considering at least a partial reversal of course.

With many states still focused only on cuts, such a bold statement from California could reverberate nationwide ? either giving other states cover to try similar measures or showing that, even with budgets in dire straits, tax increases are a political impossibility.

?A victory for tax increases in?California?could encourage similar moves in other states,? says Jack Pitney, a political scientist at?Claremont?McKenna?College. ?If the tax measure goes down to defeat ? in a blue state running a huge deficit ? the effect would be to chill such proposals in other states for many years to come.?

Brown?s proposal is projected to raise $7 billion per year and would expire in 2016. On Monday, he dismissed the idea of going through the legislature, where a two-thirds vote is needed for raising taxes. Republicans blocked Brown?s efforts to raise taxes through the budget process last fiscal year.

?I am going directly to the voters because I don?t want to get bogged down in partisan gridlock as happened this year,? said Brown in a statement. ?The stakes are too high.?

He suggested that the state can?t make any more cuts responsibly. ?Spending is now at levels not seen since the ?70s,? he said. ?Schools have been hurt, and state funding for our universities has been reduced by 25 percent. Support for the elderly and the disabled has fallen to where it was in 1983.?

?The stark truth is that without new tax revenues, we will have no other choice but to make deeper and more damaging cuts to schools, universities, public safety, and our courts,? he added.

The depth of recent cuts may have changed minds in California. Some 64 percent of California voters said they would pay more taxes if the money went to public schools, according to a November poll by the Los Angeles Times and the University?of?Southern California.

?Now people are seeing how spending cuts are hitting the most vulnerable ? elderly and kids in school,? says?Loyola?Law?School?professor Jessica Levinson, former director of political reform at the Center for Governmental Studies.

But analysts say the sheer number of initiatives may overload voters.?Moreover, Republicans could try to counter with initiatives of their own.

?While Brown may be successful in persuading some of his allies in his tax-increase battle to remove their initiatives from the ballot, one might imagine that his opponents will decide to pursue a voter misdirection strategy by seeking to add counterbalancing initiatives of their own,? says Lara Brown, a Villanova University professor and author of ?Jockeying for the American Presidency.?

The stakes are high for what might follow in other states. ?In the same way that Proposition 13 did, indications are that California is willing to turn the corner on what government is and our willingness to fund it,? says Barbara O?Connor, director emeritus of the Institute for Study of Politics and Media at California State University, Sacramento. ?Perhaps it is time to lead the rest of the country out of the morass by example.?

Jury talks for 2nd day in Conn. home invasion case (AP)

NEW HAVEN, Conn. ? A Connecticut jury was deliberating for a second day on whether a man convicted of killing a woman and her two daughters in a brutal home invasion should get the death penalty or life in prison.

The jury deliberated less than two hours Monday afternoon without reaching a verdict in the sentencing phase of Joshua Komisarjevsky's trial in New Haven Superior Court. They continued their discussions Tuesday.

Komisarjevsky and Steven Hayes were convicted of killing Jennifer Hawke-Petit and daughters, Hayley and Michaela, at their Cheshire home in 2007. Hayes is on death row.

"It's just a long wait. It's a hard wait," said William Petit Sr., whose granddaughters and daughter-in-law were killed. "By the same token, we know it's very close to being over."

Defense attorneys say Komisarjevsky should not be condemned to death because was sexually abused as a child by his foster brother and never got proper psychological help. Prosecutors cite the heinous and cruel nature of the crime.
